To be reinstated, you must establish to the satisfaction of U.S.CIS that either, the violation resulted from circumstances beyond your control or that failure to reinstate to lawful F-1 status will result in extreme hardship to you.
If you have not maintained your student status requirements set forth by U.S. Citizenship and Immigration Service's regulations (i.e. not being enrolled during a required academic term, not completing the required number of hours to be considered full-time, not satisfactorily completing your degree within the maximum allotted time), then you are required to apply for a reinstatement of your student status.
This is necessary for you to regain F-1 benefits lost with violation of status.
Being in violation of status will also affect your opportunity to transfer to another school.
To Apply:
1. PERSONAL LETTER titled: "To Whom It May Concern:"
Introduction: name, country of foreign residence, you are requesting a reinstatement of your F-1 (student) status.
Body of the Letter: Statement thoroughly clarifying the period of time of your violation and the circumstances contributing to your loss of status.
Statement which demonstrates the problem(s) contributing to our loss of status has/have been corrected.
Statement indicating that if your status is reinstated, you will maintain your full-time enrollment through your expected date of completion of studies (Provide Date).
Finish with a statement with indicates that it will create extreme hardship for you to return to your country without completing your educational objective.
2. DOCUMENTATION:
You must provide evidence, which supports your reason(s) given for violation of status as well as proof that the situation has been corrected (i.e. Letter from parents, letter from your department chairman and /or, academic advisor etc.).
3. UPDATED FINANCIAL STATEMENT:
A valid financial statement demonstrating your financial ability to cover tuition, fees, and basic living expenses while continuing your full-time enrollment.
4. COMPLETE FORM I-539
5. $200 Fee (personal check or money order made to the Department of Homeland Security)
You must have Forms I-20, I-94 and a valid passport (minimum additional six months)
